1. Agreement
By using our services or completing a transaction, you agree to these Terms and Conditions. If you do not agree, do not use our services.
2. Parties
These terms govern the relationship between CASH CARDS MILES & POINTS Inc. and you (the user/customer).
3. Services
The scope of services is defined in the respective product or service description or individual agreement.
4. Prices and Payment
Prices are as stated at the time of order. All prices exclude VAT unless otherwise indicated. Payment is due as specified at checkout.
4.1 Third-Party Payment Processors
Payments are processed by third-party providers (e.g., Stripe, PayPal, Payoneer). By selecting a payment method, you agree to the applicable provider's terms. We are not liable for delays, errors, chargebacks, or privacy violations caused solely by these providers.
5. Software and Hosted Services (SaaS)
If we offer software or hosted services, we provide them subject to the agreed availability and security standards. Customer data is processed in accordance with our Privacy Policy and applicable data processing agreements. We are not liable for outages, data loss, or security incidents caused solely by third-party infrastructure providers. We recommend that customers maintain their own backups.
6. Your Rights as a Consumer
If you are a consumer, you have certain statutory rights under the Consumer Rights Act 2015 and other UK legislation, including rights to cancel and refund in certain circumstances. These terms do not affect your statutory rights. A separate cancellation notice will be provided where applicable (e.g., for distance or off-premises contracts).
7. Limitation of Liability
We are not liable for indirect, incidental, consequential, or punitive damages. Our total liability is limited to the amount you paid us in the twelve months preceding the claim. We do not exclude liability for death, personal injury, fraud, or where prohibited by law.
We are not liable for damages caused by third-party payment processors or infrastructure providers beyond our control.
8. Governing Law and Jurisdiction
These terms are governed by the laws of England and Wales (or Scotland/Northern Ireland, as applicable to your business). The courts of Miami, USA have exclusive jurisdiction, except where you have statutory rights as a consumer to bring proceedings in your place of residence.
9. Changes
We may update these terms from time to time. We will notify you of material changes by posting the updated terms on this page with a new effective date. Continued use of our services after changes constitutes acceptance.
10. Severability
If any provision of these terms is found unenforceable, the remaining provisions remain in effect.
